16.06.2022 sdas rejected C.R.M. (NDPS) 638 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Katwa Police Station Case No. 229 of 2018 dated 08.05.2018 under Sections 21(c )/29 of the NDPS Act.

Majumder ... for the petitioner Mr. Sanjoy Bardhan Ms. Debjani Dasgupta ... for the State Having considered the materials on record disclosing prima facie involvement of the petitioner and co-accuseds in the alleged possession of narcotic substance above commercial quantity i.e. 700 grams of Heroin and in view of statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected. Trial court is directed to take prompt steps to conclude the trial at an early date preferably within one year from the next date fixed for recording evidence without granting any unnecessary adjournment to either of the parties.
