ar The appeal is of the year 2008.

The matter appeared initially on 20th June, 2008 before a coordinate bench when the matter was directed to go out of list as the certified copy of the judgment of the trial court has not been filed.

It further appears that during the pendency of the appeal respondent no. 2 died and the appellant filed substitution application being CAN 6255 of 2009. Till date no step was taken by the appellant for allowing such substitution application. We feel that the appellant is not interested to proceed with the substitution application for such a long period.

In view there of, the appeal stands dismissed for default along with CAN 5312 of 2009 and CAN 6255 of 2009.
