In Re: An application under Section 483 read with Section 482 of the Code of Criminal Procedure, 1973;

Md Sukchand Sk @ Sukchand Sk

Versus

The State of West Bengal Mr. S. Das Mahapatra, Mr. Ali Ahsan Alamgir, Ms. Soma Mal, Ms. Rabia Khatun.

...for the petitioner.

Mr. Joydeep Roy, Ms. Sujata Das.

...for the State.

Petitioner is directed to serve a copy of the revisional application upon Ms. Sujata Das, learned advocate, who ordinarily appears on behalf of the State. Her appearance may be regularised by the concerned authorities.

The revisional application has been preferred for expeditious disposal of sessions case arising out of Islampur Police Station Case No.40 of 2003 dated 11.05.2003. The last of the ordersheet reflects that the case has been committed to the learned Additional Sessions Judge, Lalbagh, Murshidabad. The petitioner is the complainant and obviously he is surprised regarding the period of 20 years passing by without the charge being framed till date. In view of the long pendency of the sessions case particularly at the pre-commitment stage, I direct the learned trial court in this case would fix at least one schedule consisting of three dates in a month so that the trial of the case can be taken to its

logical conclusion within a reasonable period of time. There are number of accused persons in this case. The learned trial court would see that they do not evade the trial of the case and impose conditions to that effect.

The SDPO/Additional S.P in-Charge of Islampur Police Station would act as a Nodal Officer of this case who would ensure regarding the production of the witnesses on the dates fixed before the learned trial court in connection with the present case being Sessions SL Case No.157 of 2022.

If the charge till date has not been framed, the learned trial court would on the next date or within a month thereafter fix date for consideration of charge and thereafter as directed above fix schedule for taking the trial to its logical conclusion at the earliest. The public prosecutor in charge of the case would take all efforts so that the materials, exhibits and documents are placed before the learned trial court on the date so fixed or the witnesses so appear. With the aforesaid observations, CRR 1734 of 2023 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
