Mr. Sandipan Maity Sk. Saifuddin ...for the petitioner Mr. Asif Dewan ..for WBSEDCL The petitioner seeks an electricity connection for his submersible pump set.

Learned counsel appearing for the West Bengal State Electricity Distribution Company Limited (WBSEDCL), on the other hand, submits that the electricity connection could not be provided due to the following reasons:

1. The submersible pump was not installed.

2. Earthing was not completed.

3. The location of the meter and meter box has not been identified or finalized.

4. Wiring has not been completed.

5. A way leave issue was identified during an inspection conducted by local villagers.

Learned counsel appearing for the petitioner, however, contends that the submersible pump set has

already been installed and that all other technical formalities have been duly complied with.

I am of the opinion that the issue concerning the way leave must be addressed by the competent authority. Accordingly, liberty is granted to the petitioner to approach the concerned District Magistrate by filing an application under Rule 3(b) of the Works of Licensees Rules, 2006. If such an application is filed within two weeks from the date of this order, the District Magistrate shall decide the matter in accordance with the law as expeditiously as possible, preferably within a period of three months from the date of receipt of the application. The District Magistrate shall provide an opportunity of hearing to the petitioner, the representative of WBSEDCL, and all other concerned parties before passing the order. A reasoned order shall be communicated to the petitioner forthwith.

Accordingly, WPA 11116 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
