Learned advocate for the petitioner submits that the subject matter of the case relates to alleged recovery of 361 gms. of brown sugar. Charge sheet has already been submitted. Charges have been framed, but witness action has not been commenced. Further, there has been no recovery from the present petitioner and the petitioner has been implicated on the basis of the statement of the co-accused.

Learned advocate for the State produces the case diary and opposes the prayer for bail. He submits that there was communication at the relevant point of time between the present petitioner and the principal accused who has been arrested.

I have taken into account the materials in the charge sheet. None of the service provider is cited as witness in the present case. Having considered the fact that 23 witnesses have been relied upon and the petitioner is in custody for one

year and one month, I am inclined to release the petitioner on bail.

Accordingly, the petitioner namely Abdul Halim be released on bail upon furnishing a bond of Rs.20,000/- with two sureties of like amount each, one of whom must be local to the satisfaction of the learned judge, Special Court under NDPS Act, 1st Court at Raiganj, Uttar Dinajpur. If on bail, the petitioner shall be physically present on each and every date of hearing before the jurisdictional court and shall not leave the district of Uttar Dinajpur without prior permission of the trial court. 5.

In the event he fails to appear before the trial court without justifiable cause, the trial court shall be at liberty to cancel his bail automatically without reference to this court. 6.

With the aforesaid observation, CRM (NDPS) 1196 of 2026 is allowed.
