1. Learned counsel for the petitioners submits that the application under Section 14 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (2002 Act) has been kept pending inordinately beyond the statutory outer limit.
2. On query of court, learned counsel for the petitioners, on instructions, submits that there is no subsisting interlocutory order from any forum restraining the said application under Section 14 of the 2002 Act from being disposed of.
3. Despite service, none appears for the private respondents at the time of call. Affidavit-ofservice filed in Court today be kept on record.
4. In view of the innocuous nature of the prayer, the writ petition is taken up for disposal.
5. In the light of the above developments, WPA No. 12242 of 2024 is disposed of by directing the respondent no. 2, that is, the District Magistrate, Nadia, to dispose of the application filed by the petitioner under Section 14 of the 2002 Act and pending before the said authority as expeditiously as possible, positively within eight weeks from date, by acting on a server copy of this order.
6. There will be no order as to costs.
7. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities. (Sabyasachi Bhattacharyya, J.)
