Affidavit of service filed by the petitioner is taken on record.

The instant writ petition has been filed complaining illegal and unauthorized construction at premises no. B/81/H/1, Dr. Suresh Sarkar Road, Kolkata- 700 014.

The municipality as also the private respondent are represented.

Though the allegations and counter-allegations have been made, I am of the view that since a complaint dated 21st April, 2026 has already been made by the petitioner, it shall be appropriate to direct the municipality to take a decision on such complaint by passing a reasoned order in accordance with law, unless a decision in this regard has already been taken. In such event, the municipality must communicate the reasoned order to the parties.

With the above observation, the writ petition stands disposed of.

It is expected that the decision to be taken by the municipality, if not already taken, shall be communicated to the parties, preferably within the period of four weeks from the date of communication of this order.

Since no affidavit in opposition is called for, the allegations made in the writ petition are deemed not to have been admitted by the respondents.
