Hossain ... for the Petitioner(s) Mr. Suman Chakraborty ... for the State-respondent(s) Learned advocate for the petitioner submits that the subject-matter of the present case relates to 26.489 kg of ganja; the petitioner is in custody for nine months and till date only charges have been framed but witness action has not commenced.

Learned advocate for the State opposes the prayer for bail and submits that witness action would commence and/or has already been commenced as the last date was fixed on 15th June, 2026.

I have taken into account the period of detention of the present petitioner as well as the time which will be consumed for taking the trial to its logical conclusion as eight witnesses have been relied upon in the charge-sheet.

Having considered the same, I am inclined to enlarge the petitioner on bail.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Suman Das shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned Judge, Special Court, under NDPS Act, Raiganj, Uttar Dinajpur.

If on bail, the petitioners shall also make himself physically available on each and every date so fixed by the learned Special Court/trial court and shall not leave the district of Uttar Dinajpur without prior permission of the learned Special court/trial court.

Accordingly, CRM (NDPS) 1104 of 2026 is allowed. Memo of Evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
