Learned advocate for the petitioners submits that the petitioners are in custody in excess of one year. He submits that FIR was lodged two months after the recovery of the dead body. Petitioners were falsely implicated in the instant case. Learned lawyer for the State draws attention of this Court to the statement recorded under section 164 Cr.P.C and two other statements under section 161 Cr.P.C.

Considering the fact that police submitted charge sheet and considering the period of detention of the petitioners, we are inclined to grant bail to the petitioners.

Accordingly, the petitioners be released on bail upon furnishing a bond of Rs. 10,000/- each with two sureties of like amount each, one of whom must be local to the satisfaction of the learned ACJM, Rampurhat on condition that the petitioners shall appear before the trial court on every date of hearing until further

orders and shall not intimidate witnesses or tamper with evidence in any manner whatsoever.

In the event they fail to appear before the trial court without justifiable cause, the trial court shall be at liberty to cancel their bail automatically without reference to this court. The application being CRM 4943 of 2021 is disposed of. (Ananda Kumar Mukherjee, J.) (Debangsu Basak, J.)
