The matter is treated as in today's list.

The petitioner's prayer is to issue appointment letter as a primary teacher. The urgency submitted by him that counselling for appointment of primary teachers is going to be held tomorrow in the district of Malda and unless this matter is heard and decided by this court in favour of the petitioner, he will lose a chance for getting an employment.

The petitioner submits that he is a graduate and has two year Diploma in Elementary Education

as has been laid down by National Council for Teachers' Education by its Notification dated 29th July, 2011. In that Notification one of the several provisions is "Graduation and two year Diploma is Elementary Education" (by whatever name known). From the result of the D.EL.ED. Examination conducted by National Institute of Open Schooling it is found that certificate has not been issued to the petitioner "due to not fulfilling the eligibility criteria of 45 % marks in Class-XII Certificate and that certification will be done after due verification". Therefore the case stands today is, he is a graduate but without certificate of two year's D.EL.ED. pass candidate. Therefore, I do not find any merit for passing any order allowing the petitioner to participate in the counselling process and this writ application is dismissed. No costs.
