2) Admittedly, the appellant has not complied with Clause 17(iv) of the tender document.

The enlistment order of the Municipality cannot be treated as sufficient compliance of Clause 17 (iv), in our prima facie view.

3) The order impugned does not call for any interference.

4) Accordingly, the appeal and the application are disposed of. His Lordship has not rejected the writ petition but only refused the interim protection.

5) Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
