Ct.No.28 as (Rejected) C.R.M. (NDPS) 643 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Special Case No.28 of 2018 arising out of Gangarampur P.S. Case No.601 of 2016 dated 29.11.2016 under Sections 22/25/27 of the NDPS Act.

In the matter of : Manik Roy.

... Petitioner.

Mr. Niladri Sekhar Ghosh, Ms. Shrimoyee Mukherjee, Ms. Sompurna Chatterjee, Mr. Sourav Mondal.

...for the Petitioner.

Mr. Saryati Datta.

...for the State.

Heard the learned Counsels appearing on behalf of the parties.

Petitioner renews his prayer for bail. He submits he is on same footing with co-accuseds who have been granted prearrest bail. Learned Advocate for the State opposes the prayer for bail and submits petitioner had absconded for six years. We have considered the materials on record. Co-accuseds were granted pre-arrest bail in 2019. Petitioner has been arrested in 2022 after a lapse of about three years. In view of the conduct of the petitioner in absconding for a protracted period of time and as his prayer for bail was

rejected in February, 2022, we do not consider it prudent to enlarge the petitioner on bail at this stage. Accordingly, the prayer for bail of the petitioner is rejected.
