Petitioner(s) Mr. Arup Kumar Bhowmick ... for the Petitioner(s) Mr. Gurudas Mitra ... for the State-respondent(s) Learned advocate for the petitioners submits that the petitioners are in custody for about nine months and have been implicated on the alleged recovery of 944 gm of brown sugar. It has also been contended that charge-sheet has been submitted and prosecution has relied upon six witnesses. However, as one of the accused persons is absconding, till date, charges could not be framed. Learned advocate for the State opposes the prayer bail and submits that in respect of one of the accused persons, the case been split up on the ground of juvenility. So far as the other accused persons are concerned, the process has been issued but the same has not been exhausted till date.

Having considered the quantum recovered in the present case, I am of the opinion that the rigors of Section 37 of the NDPS Act is attracted, as such, I am not inclined to enlarge the petitioner on bail.

Hence, the prayer for bail of the petitioners is Rejected.

However, the learned trial court is directed to exhaust the process of law and, if required, split up the trial and proceed with the case so far as the present accused persons are concerned.

Accordingly, CRM (NDPS) of is dismissed.
