In this writ petition, the writ petitioners have prayed for expeditious disposal of the original application being O.A. 1013 of 2021 filed before the West Bengal Land Reforms and Tenancy Tribunal, Kolkata.

It appears that the petitioners have preferred an appeal being Appeal Case No. 190 of 2020 before the appellate authority being the District Land and Land Reforms Officer, Purba Medinipur, who is the respondent no. 3 in the present writ petition, against an order dated January 21, 2020 passed by the Block Land and Land Reforms Officer, Moyna, Purba Medinipur, in Case No. 1 of 2020.

It is submitted on behalf of the writ petitioners that the appellate authority did not fix any date for hearing of the appeal. Being aggrieved, the writ petitioners have approached the West Bengal Land Reforms and Tenancy Tribunal, Kolkata. It appears that the original application appeared before the Second Bench of the tribunal on April 20, 2021 and the tribunal fixed the matter for hearing on December 21, 2021. Under such circumstances, prayer is made for expeditious disposal of O.A. 1013 of 2021.

We have heard Mr. Ranjit Kumar Roy, learned

advocate appearing on behalf of the petitioners and Mr. Supratim Dhar, learned advocate appearing on behalf of the State respondents. In the interest of justice, we feel that justice will be subserved if the respondent no. 3 is directed to dispose of the Appeal Case No. 190 of 2020 pending before him. Accordingly, the respondent no. 3, being the District Land and Land Reforms Officer, Purba Medinipur, is directed to dispose of Appeal Case No. 190 of 2020, after giving reasonable opportunities of hearing to the parties and by passing a reasoned order thereon, on or before December 31, 2021. The respondent no. 3 shall communicate his decision to the parties within a week from the date of taking his decision.

In view of the order, as aforesaid, nothing remains to be decided in the original application filed before the tribunal and the same being O.A. 1013 of 2021 is accordingly disposed of. The Legal Remembrancer, West Bengal, is directed to regularise the appointment of Mr. Supratim Dhar, learned advocate appearing on behalf of the State.

The writ petition is, thus, disposed of without any order as to costs.

Office is directed to communicate this order to the Second Bench of West Bengal Land Reforms and Tenancy Tribunal, Kolkata, immediately.
