This application under Article 227 of the Constitution of India was filed challenging the order passed by the Opposite Party No.1 directing demolition of the suit property before the Municipal Building Tribunal, Kolkata being appeal no. 6 of 2024. As there was no Presiding Officer in the learned Tribunal, an application under Article 227 of the Constitution of India was filed for interim relief. It is submitted by the learned advocates that now

the Tribunal is presided by an officer to decide the appeal cases.

In the facts and circumstances this application is disposed of by granting leave to the petitioner to take necessary steps in the appeal which is pending before the Kolkata Municipal Building Tribunal in accordance with law.

The interim order granted earlier shall stand extended for a period of 8 weeks.

The revisional application along with CAN 1 of 2024 are disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties expeditiously after completion of all necessary formalities.
