Ms. Indumouli Banerjee ... for the State-respondent(s) Re Learned advocate for the petitioner complains that the petitioner is the victim of sexual abuse and is subjected to threat at the behest of the accused/private respondents.

It is further alleged that the investigating officer of the case along with the accused persons are threatening the present petitioner.

To that effect, information were furnished with the concerned authorities, but, no steps have been taken.

The petitioner also alleges that the

family members of the petitioners are also feeling insecured because of the overt acts of the private respondents.

State has submitted a report which reflects that on behalf of the petitioner following cases being Pukhuria PS Case No. 445 of 2023; Pukhuria PS Case No. 459 of 2023; Pukhuria PS Case No. 498 of 2023; Pukhuria PS Case No.

503 of 2023 and Pukhuria PS Case No.

531 of 2023 have been registered.

It has also been further contended in the report that against the petitioner and/or her family members or acquaintances nine cases being Pukhuria PS Case No. 339 of 2023; Pukhuria PS Case No. 361 of 2023; Pukhuria PS Case No. 430 of 2023; Pukhuria PS Case No.

500 of 2023; Pukhuria PS Case No. 535 of 2023; Pukhuria PS Case No. 544 of 2023; Pukhuria PS Case No. 545 of 2023; Pukhuria PS Case No. 592 of 2023; Pukhuria PS Case No. 35 of 2024

have been registered.

Report also depicts that pursuant to the directions passed in WPA 2419 of 2024 dated 05.02.2024, police picket has been deployed beside the house of the petitioner within the jurisdiction of Pukhuria Police Station. No report of untoward incident or threat has been received by the petitioner or any of his family members from the time when such police picket was deployed and, till date, police camp exists there and regular police patrolling is in the area.

On an assessment of the steps taken by the police authorities, I am of the opinion that the police authorities have taken steps inconsonance with the earlier directions so passed. If the petitioner has any specific accusation against any individual, the same may be brought to the notice of the learned ACJM, Chanchal, Malda.

The learned ACJM, Chanchal, Malda, if required, would call for a report,

assess as also ascertain the ground reality and, thereafter, pass necessary directions/orders under the Witness Protection Scheme, 2018.

With the aforesaid observations, WPA 11233 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.
