1) Petitioner being a primary teacher working under District Primary School Council, Birbhum prays for transfer. In support of such prayer, notice of this Court has been drawn to transfer application dated 15th March, 2025 which is at page 24 of the writ petition wherefrom it appears that petitioner being surplus teacher made such application for transfer. It is submitted that since petitioner has completed five years of confirmed service as primary teacher, there is no impediment under the relevant transfer rules in transferring the petitioner from her present school to another school in the district of Birbhum.

2) Mr.

Chowdhury, learned advocate representing District Primary School Council, Birbhum submits that Chairman of the Council

may be directed to consider the transfer application of the petitioner in accordance with law.

3) Having considered the submissions made on behalf of the parties, writ petition stands disposed of directing Chairman, District Primary School Council, Birbhum being respondent no. 6 to decide the transfer application of the petitioner by six weeks from date of communication of this order. Decision to be taken by respondent no.

shall be communicated to the petitioner by fortnight thereafter.

4) However, transfer application of the petitioner shall not be rejected on the ground of suspension of Utshasree portal.

5) There shall be, however, no order as to costs.

6) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
