The instant revision is filed by the accused/petitioner who is in custody almost a year under Section 21 (C)/29 NDPS Act. The petitioner has prayed for expeditious disposal of the case being NDPS Case No.127 of 2021 pending before the learned Judge, Spl. Court under NDPS Act cum ADJ, 5th Court, Berhampore, Murshidabad.
It is submitted by the learned Advocate for the petitioner that the petitioner is in custody for about a year. Charge-sheet has been filed against the petitioner on 31.10.2021. On 05.06.2022 charge was framed under Section 21(C)/29 of the NDPS Act against the accused. However, no witness has been examined till date.
It is also submitted by the learned Advocate for the petitioner that there are 18 charge-sheeted
witnesses who are required to be examined by the Trial Court. Therefore, the petitioner has prayed for expeditious disposal of the case bearing No. NDPS Case No.127 of 2021.
Considering the fact of the case and the nature of the prayer, this Court is of the view that the instant criminal revision can be disposed of at the stage of motion. Accordingly, the learned Trial Judge is requested to take all endeavour to conclude examination of witnesses within one year from the date of communication of the order.
In all practicality, NDPS Case No.127 of 2021 shall have to be disposed of within one year from the date of communication of this order The petitioner is at liberty to communicate the server copy of the order and the learned Trial Court shall act upon the server copy of the said order. The instant criminal revision is, thus, disposed of.
