Having considered the materials on record including the statements of witnesses and contemporaneous document i.e. seizure list showing recovery of 500 grms brown sugar above commercial quantity from the possession of the petitioner, we are of the opinion that in view of the statutory restrictions under Section 37 of the N. D. P. S. Act, this is not a fit case to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner is rejected.

However, trial court is requested to expedite the trial and conclude the same at an early date without granting unnecessary adjournment to either of the parties. (Ananya Bandyopadhyay,J.) (Joymalya Bagchi, J.)
