Affidavit of service filed in Court is taken on record.

The petitioner, being aggrieved by the failure on the part of the municipal authorities to decide on the mutation application, the instant writ petition has been filed.

Learned advocate for the petitioner has drawn attention of this Court to the document appearing at page 52 of the writ petition and would submit that though the mutation application was received in Form No.A-42 from the petitioner on 30th January, 2019, the municipal authorities are yet to take a decision on the same. Though the representations have been made from time to time, the municipal authorities are yet to dispose of such representation.

Ms. Quraishi, learned advocate appears on behalf of the Kolkata Municipal Corporation.

Having heard the learned advocates appearing for the respective parties, I am of the view since a mutation application has been filed, the least that is expected, the disposal of such application. The municipality cannot be permitted to sit tight on such application.

Accordingly, the municipal authorities are directed to dispose of such application in accordance with law, preferably within a period of sixteen weeks from the date of communication of this order.

With the above observations and directions, the writ petition is disposed of.

Urgent Photostat certified copy of this order, if applied for be given to the parties upon compliance with the requisite formalities.
