Affidavit of service filed in Court is taken on record.

The petitioner is aggrieved that in respect of a complaint dated 06.03.2023, addressed to Beliaghata Police Station, one S. I., namely, Haranath Mukherjee attached to the said Police Station was harassing the petitioner to settle with the accused persons. 3.

The petitioner lodged a further complaint in this regard on 25.03.2023 over email to the Deputy Commissioner of Police, Commissioner of Police, Kolkata Police and the Officer-in-Charge, Beliaghata Police Station.

FIR No. 53 of 2023 dated 29.03.2023 came to be registered by the Beliaghata Police Station in which the same Haranath Mukherjee was appointed as I. O. 5.

The petitioner is aggrieved that an accused in the FIR cannot be appointed as I.O. in the same case. 6.

In those circumstances, this Court directs the Joint C. P., Kolkata Police to nominate a suitable

officer from his office to act as I.O. in the instant case and complete investigation.

It is ordered that investigation into the subject FIR shall be completed within a period of two months from date.

The writ petition is disposed of.

9.

There will be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
