Special Case No.54/2022 arising out of Murshidabad Police Station Case No. 708 of 2022 dated 03.11.2022 under Sections 363/365/34 of the Indian Penal Code and adding Section 4 of the Protection of Children from Sexual Offences Act, and Charge sheet submitted being Charge Sheet no.15/2023 dated 21.01.2023 under Sections 363/365/376/34 of the Indian Penal Code and Section 4 of the Protection of Children from Sexual Offences Act.

And In the matter of : Utpal Mandal @ Utpal Mondal ...... petitioner Mr. Tapodip Gupta ....for the petitioner Mr. Abhra Mukherjee, Mr. Gautam Banerjee ....for the State Victim recorded her statement under Section 164 of the Criminal Procedure Code where, the victim implicates the petitioner in kidnapping and raping her.

Police filed charge-sheet.

Considering the gravity of the offence and involvement of the petitioner in the incident as transpiring therefrom, we are unable to grant anticipatory bail to the petitioner. CRM (A) 1968 of 2023 is rejected.
