Mr. Salil Kumar Maiti Ms. Pinki Saha ..for the petitioner Mr. S. M. Hassan Ms. Anupama Yasmin ..for Haldia Municipality The petitioner alleges that respondent no.9 is constructing a building at Plot No.2041 under Mouza Basudebpur, J.L. No.126, Haldia, Purba Midnapore without any sanctioned plan.

The petitioner alleges that he made a representation dated February 27, 2024, before Haldia Municipality against such unauthorised construction but the Municipality has not taken any steps. Learned advocate representing the Municipality also submits that respondent no.9 is undertaking the construction without any sanctioned plan.

In view of the aforesaid facts, I dispose of this writ petition giving a direction upon Haldia Municipality to consider the representation dated February 27, 2024, in accordance with law within a

period of two months from the date of communication of this order. In arriving at its decision, the Municipality shall hear the petitioner as well as the persons responsible for making the construction. The Municipality shall pass a reasoned order and communicate the same to the parties within a period of seven days thereafter.

Accordingly, WPA 12255 of 2024 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
