And In Re : Balak Kotal alias Balak Katal .... Petitioner Mr. Sakabda Roy Mr. Anindya Halder ....for the petitioner Ms. Minoti Gomes Mr. Karan Bapuli ...... for the State 1.

Learned Counsel for the petitioner submits he is in custody for 461 days. He further submits there is delay in trial. He prays for bail.

Learned Counsel for the State opposes the bail prayer and submits six witnesses have already been examined.

3. We have considered the materials on record. Petitioner had committed dacoity along with others. Trial is in progress and six witnesses have been examined. If the petitioner is released on bail at this stage he may abscond and commit similar offence. Under such circumstances, we are not inclined to grant bail to the petitioner.

4. The application for bail is, thus, rejected.

5. Trial court is directed to expedite the trial and conclude the same at the earliest without granting unnecessary adjournment to either of the parties.
