Mr. Rudradipta Nandy Mr. S. Balial ... For the State The petitioner seeks parity with co-accused Sk Akib who has been granted bail earlier.
Learned counsel for the State does not oppose the fact. In view of the fact that the petitioner is similarly circumstanced with co-accused Sk Akib who is on bail, he is entitled to the same benefit.
Accordingly, the prayer for bail is allowed.
The petitioner namely Rajesh Mollick @ Joy shall be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Howrah subject to condition that he shall remain outside the district of
Howrah except for the purpose of appearing before the learned trial Court on every date of hearing. He shall not tamper with evidence or intimidate witnesses in any manner whatsoever. He shall provide his mobile number to the learned trial Court, the investigating officer, inspector in charge/the officer in charge of Jagatballavpur police station and shall not change the same without prior intimation to the said authorities.
In the event the petitioner fails to adhere to any of the conditions stated hereinabove, the learned trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.
The application for bail is disposed of.
