State of West Bengal and others Mr. Rahul Karmakar, Mr. Debabroto Roy, Mr. Sounak Mukherjee .... for the petitioner Mr. Sourojit Dasgupta, Ms. Mandira Tarat, Mr. Rupal Singh, Mr. Ashok Kumar Singh .... for the respondent nos. 2 & 3 Learned counsel for the petitioner seeks to move this court on the ground of urgency, due to nonavailability of the appropriate tribunal at the time of filing the writ petition.

However, learned counsel appearing for the respondent nos. 2 and 3 submits that in the meantime, a Presiding Officer has been appointed and is functioning in the concerned Bench of the tribunal, that is, the DRT-III, Kolkata.

In such view of the matter, WPA No. 11463 of 2023 is disposed of with liberty to the petitioner to move the identical challenge initiated by the petitioner before the said tribunal and to raise all disputes as

sought to be raised in the present writ petition before the said forum.

It is made clear that the merits of the disputes have not been gone into by this court at all. It is expected that the tribunal shall, when so approached by the petitioner, make endeavour to decide the petitioner's matter expeditiously. There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
