Mr. Haradhan Mondal ...for the petitioner This application under Article 227 of the Constitution is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Junior Division), 2nd Court, Bolpur to dispose of a miscellaneous case filed under the provisions of Order XXXIX Rule 2(A) CPC arising out of Title Suit No.142 of 2023 expeditiously. Learned counsel for the petitioner draws the attention of this court to Order No.6 dated December 2, 2024 wherein the learned Civil Judge (Junior Division), 2nd Court, Bolpur directed the application filed under Order XXXIX Rule 2(A) to be registered as Misc. (J) Case. It will be open for the petitioner to draw the attention of the learned trial judge in that regard. Learned advocate for the petitioner further submits that the application under Order XXXIX Rule 2(A) CPC has been fixed for peremptory hearing.

In the light of the submission made on behalf of the petitioner, CO No.1817 of 2025 stands disposed of by requesting the learned Civil Judge (Junior Division), 2nd Court at Bolpur to make an endeavour to dispose of the application under Order XXXIX Rule 2(A) CPC in connection with Title Suit No.142 of 2024 as expeditiously

as possible without granting unnecessary adjournments to either of the parties.
