123/2020 dated 20.03.2020 under Sections 395/397/412 of the Indian Penal Code.
And In the matter of: Raju Ray @ Bishal ....Petitioner Ms. Minoti Gomes ...for the Petitioner Mr. Swapan Banerjee Mr. Anindya Sundar Chatterjee ...for the State.
Petitioner is in custody for 604 days. Learned lawyer for the petitioner submits recovery was from a place which was under control of another person namely, Shibu Kumar Sharma. Learned senior government advocate opposes the prayer for bail. He submits petitioner is a member of an inter-state gang of dacoits and he has criminal antecedents.
We have considered the materials on record. Petitioner has a number of criminal cases in the State of U.P.. He was arrested in the present case and recovery was made from a place which had been given on rent to the petitioner.
In view of the aforesaid incriminating facts and the criminal antecedents of the petitioner, we do not consider it prudent to release him on bail.
The application for bail is, thus, rejected.
We direct the trial Court to consider issue of framing of charge at the earliest, preferably within one month from date and
in the event charge is framed to take the proceeding to its logical conclusion without delay.
