This is an application under Section 378(4) of the Code of Criminal Procedure filed by the petitioner praying for special leave to file appeal against an order of acquittal passed by the learned Metropolitan Magistrate, 20th Court, Calcutta. I have perused the impugned judgment. Special leave to file appeal against the judgment and order of acquittal passed by the learned Court below in case No.0050253 of 2016 be allowed. The petitioner is directed to file memorandum of appeal within 30 days from the date of this order.
The names of the learned Advocate for the petitioner, namely Anuj Singh, Ms. Niharika Singh and Mrs. Supriya Singh Advocates be sent to the Office of the petitioner informing the petitioner that the learned Advocates engaged by the petitioner have not taken any step at the time of hearing of the instant proceeding and the Court suo moto has passed the above order in the absence of the above-named learned Advocates.
