Ismail ...for the State Enquiry Report in respect of health condition of the son of the petitioner is taken on record.

It is submitted on behalf of the petitioner that 101 kilograms of ganja was allegedly recovered from three accused persons. However, during investigation, the said accused persons disclosed the name of present petitioner and it is the prosecution case that on the basis of the statement of the coaccused, the Investigating Agency conducted search and seizure and allegedly recovered 23 kilograms ganja from the possession of the present petitioner. However, investigation has already been ended in charge sheet in the present case. One of his sons is suffering from kidney problems since 2023 and unless the petitioner is released on bail, his son will not get proper treatment and as such, he may be released on interim bail on any terms and conditions.

Learned Counsel appearing on behalf of the State opposes the bail prayer contending that commercial quantity of narcotics substance was recovered from the possession of the present petitioner. He further submits that investigation has already been ended in charge sheet and the next date is on 20.08.2025 for charge hearing and the trial would commence soon.

Having considered the submissions made on behalf of the petitioner and the State and on perusal of the materials available in the case diary, there are reasons to believe that the petitioner is guilty of committing offence and the rigor of Section 37 of the NDPS Act attracts in respect of the present petitioner.

Considering the aforesaid circumstances, the prayer for bail is considered and rejected at this stage. Accordingly, CRM (NDPS) 598 of 2025 is disposed of. Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
