Learned advocate for the petitioner approached this Court as no steps were being taken by the police authorities to submit supplementary charge sheet in connection with Suti Police Station Case No. 420 of 2024 dated 16.06.2024 under section 302/34 of the Indian Penal Code.

State has submitted a report. Report reflects that supplementary charge sheet dated 18.03.2025 has been submitted before the jurisdictional court.

photocopy of the supplementary charge sheet has been enclosed along with the report. A warrant of proclamation has been issued against an accused namely, Nimchand Mondal.

Having considered that such steps have been taken by the police authorities, at this stage, the only direction which can be passed upon the jurisdictional court is that the jurisdictional court will exhaust the process of law for tracing out the absconding accused and if there is unnecessary delay the jurisdictional Trial Court will see to the relevant provisions of BNSS for commitment of the case to the learned Sessions Judge and the learned Sessions Judge will not deter to proceed with the trial of the case in absentia of the absconding accused.

With the aforesaid observations WPA 11306 of 2025 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate for the petitioner.
