No.237 Suman CRR 2167 of 2026 Samad Sk -vs- The State of West Bengal Mr. Subrata Karmakar Mr. Prince Akhtar ..for the petitioner Mr. Subir Ganguly Mr. Sandeep Prasad Shaw ..for the State The petitioner seeks expeditious hearing of IE Case No. 443 of 2017 pending before the Judge, Special Court-cum-Additional District Judge, Berhampore at Murshidabad. The petitioner is the sole accused in this case. It appears that charge sheet in this case was filed on May 25, 2017. Thereafter, on several dates the petitioner did not appear. As such, the copy could not be served upon the petitioner. It appears that the matter was taken up for hearing on March 24, 2026 when the petitioner was absent and the learned Judge was pleased to fix December 16, 2026 for appearance and copy.

It was further directed that in default, the warrant of arrest shall be issued against the petitioner. I find that the absence of the petitioner caused delay in proceeding with the case. However, keeping in mind that the case is pending for about a decade, I direct the petitioner to appear before the learned Special Judge within two weeks from date. After service of the copy, learned Judge shall conclude the charge hearing within a period of two months thereafter.

With the aforesaid directions, CRR 2167 of 2026 is disposed of.
