AD 42 June 12, 2026 Ct. 28 SG CRM(A) 1498 of 2026 Reject An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Baishnabnagar P.S. Case No.1211 of 2025 dated 18.09.2025 under Sections 21(c)/27(A)/29 of the NDPS Act. And In the matter of: Moktar Sk @ Md. Moktar Sk and another ... petitioners Md. Wasim Akram Mr. Samir Mishra ... for the petitioners Mr. Imran Siddiqui ... for the State Learned counsel for the petitioners submits that the petitioners have been falsely implicated in this case. The only material available against the petitioners is the statement of a co-accused which is not admissible in evidence. Chargesheet has been submitted. Learned counsel for the State relies on the case diary and strongly opposes the prayer for anticipatory bail. He submits that other than the statement of a co-accused, there are call detail records which show that the present petitioners had phone call conversations with the arrested accused at the relevant time.

Considering the above, the other materials available in the case diary and the restrictions contained in Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
