Petitioner is directed to serve a copy of the revisional application upon Mr. Sanjib Kumar Dan, learned advocate who ordinarily appears on behalf of the State. His appointment may be regularized by the concerned Authorities in due course. Mr. Chatterjee, learned advocate for the petitioner submits that the petitioner is in custody since 17th July, 2021 i.e., 23 months. In view of the aforesaid, the anxiety expressed by the petitioner is justified.
It has been submitted that in the present case chargesheet was submitted in the month of January, 2022 and charge was framed in August, 2022 and out of 12 witnesses, four witnesses have already been examined.
Additionally, it has been submitted that out of 12 witnesses so cited by the prosecution, 10 of the witnesses belong to the Department and there are two independent witnesses. In view of the petitioner being in custody for 23 months, I
direct the learned trial court to fix a schedule of three dates and fix a schedule on each and every 45 days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournments should be granted to either of the parties.
In case, any witness is absent, learned special court would immediately communicate with the Superintendent of Police who is maintaining a register in respect of NDPS cases and its progress. The Public Prosecutor appearing in the cases would produce the materials, documents and exhibits for examination of the witnesses. All efforts be taken by the stake-holders to complete the trial at the earliest.
With the aforesaid observations, the present revisional application being CRR 1748 of 2023 is disposed of. Pending applications, if any, are consequently disposed of.
