The petitioner is the sole accused in this case. It appears that charge sheet in this case was filed on July 19, 2017. Thereafter, on several dates the petitioner did not appear. As such, the copy could not be served upon the petitioner. It appears that the matter was taken up for hearing on January 15, 2026 when the petitioner was absent and the learned Judge was pleased to fix September 18, 2026 for appearance, copy and charge.

I find that the absence of the petitioner caused delay in proceeding with the case. However, keeping in mind that the case is pending for about a decade, I direct the petitioner to appear before the learned Special Judge within two weeks from date. After service of the copy, learned Judge shall conclude the charge hearing within a period of two months thereafter.

With the aforesaid directions, CRR 2169 of 2026 is disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
