According to the petitioner, although a visitation right had been given by the learned court, the opposite party is not complying with such order. Hence, there is urgency for the disposal of the application for custody of the child.

This court has not gone into the merits of the pending Misc case. As order of expeditious disposal of any litigation is innocuous and enures to the benefit of all the parties, thus, the revisional application is not required to be served upon the opposite party, before its disposal.

Under such circumstances, this court directs the learned court below to dispose of the Act VIII case No. 65 of 2019, within a period of four months from the next date fixed, without granting unnecessary adjournments to either of the parties.

Accordingly, the revisional application is disposed of.

Petitioner is directed to serve a copy of the revisional application upon the opposite party, along with the server copy of this order.

All the parties are directed to act on the basis of the server copy of the order.
