Mr. Achin Jana Mr. Sourav Chakraborty Mr. Suman Chakraborty Mr. Prosenjit Ghosh Mr. Bhaskar Dalui ... for the Petitioner This is an application wherein the petitioner has prayed for innocuous prayer for expeditious disposal of the present proceeding being G.R. case no. 1220 of 2015, presently pending before the learned Judicial Magistrate, 3rd Court, Ranaghat, Nadia.

It is submitted on behalf of the petitioner that the wife/defacto-complainant in respect of the Ranaghat Police Station case no. 238 of 2015 under Section 498A/406/34 of the IPC and after completion of investigation, the police submitted charge-sheet on 25th July, 2015. Thereafter, the charge was also framed on 31st August, 2016 but since then, the examination of witnesses has not been commenced and the next date has been fixed by the court below on 24.9.2026. Accordingly, the petitioner seeks for a direction upon the court below for expeditious disposal of the said proceeding.

Having heard learned counsel for the petitioner, it appears that if any order passed in terms of the prayer made by the petitioner, neither party will have no cause to prejudice and as

such the service of copy of the application upon the opposite party is dispensed with.

Having considered the facts and circumstances of the case and that inordinate delay caused in examination of the witnesses for the last 10 years, I find that the prayer made by the petitioner is justified and is required to be allowed for the ends of justice. In such view of the matter, CRR 2230 of 2025 is hereby disposed of with the direction upon the court below to make every endeavour for expeditious disposal of the aforesaid proceeding being G.R. case no. 1220 of 2015 without granting any unnecessary adjournment to either of the parties and to make his best endeavour to conclude the entire proceeding preferably within a period of six months from the date of communication of the order after proponing the schedule date.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of the all requisite formalities.
