Act)-cumAdditional District Judge, Berhampore at Murshidabad. The petitioner is the sole accused in this case. It appears that charge sheet in this case was filed on July 19, 2017. Thereafter, on several dates the petitioner did not appear. As such, the copy could not be served upon the petitioner. It appears that the matter was taken up for hearing on April 24, 2026 when the petitioner was absent and the learned Judge was pleased to fix December 16, 2026 for appearance and charge.

Learned advocate appearing for the petitioner submits that due to some personal difficulties, the petitioner could not appear before the learned Additional District Judge in the Court below. However, he undertakes before this Court to appear within two weeks from date.

In view of the aforesaid, learned Judge in the Court below is directed to conclude the charge hearing within a period of two months from the date of appearance of the petitioner. With the aforesaid directions, CRR 2170 of 2026 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
