In the instant revisional application was filed challenging the order passed by the learned Sessions Judge, Birbhum in Sessions Case No. 121 of 2009 vide order dated 17.05.2011 rejecting the prayer of the petitioners for discharge from the instant case and also framing charge under Sections 302/34 of the Indian Penal Code. The learned advocate for the State submits a report filed by the S.I. of Police Khayrasole Police Station, Birbhum stating that petitioners/accused persons were acquitted under Section 235(1) of the Code of Criminal Procedure in connection with the aforesaid case. Vide judgment dated 24.03.2014 passed by the learned Sessions Judge, Birbhum at Suri in Sessions Trial No. 1(12) 2010 arising out of the Sessions Case No. 121(2009). The said report of S.I. of Police dated 08.05.2023 along with a copy of the judgment as aforesaid be kept on record.

Under such circumstances, the instant revisional application has become infructuous and disposed of accordingly. Copy of the order be sent to the trial court for necessary information.
