Petitioner is directed to serve a copy of the revisional application upon Mr. Provas Bhattacharya, learned advocate who ordinarily appears on behalf of the State. His appointment may be regularized by the concerned Authorities in due course. Mr. Chatterjee, learned advocate for the petitioner submits that the petitioner is in custody since 10th October, 2021 i.e., more than 21 months in connection with NDPS Case No. 236 of 2021. It has been submitted that in the present case chargesheet was submitted on 5th April, 2022 and charge was framed in November, 2022.

Additionally, it has been submitted that out of 11 witnesses so cited by the prosecution, 6 of the witnesses have already been examined and in this case all the witnesses belong to the Department.

Having considered the detention of the petitioner, I am of the view that the anxiety expressed by the learned advocate for the

petitioner is justified. No unnecessary adjournments should be granted to either of the parties.

The learned special court is directed that in case there is any delay of any witness not appearing, direct communication be made to the Superintendent of Police of the District for compelling his appearance. The learned Public Prosecutor conducting the case would produce the materials, documents and exhibits for examination of the witnesses. All efforts be taken by the stakeholders to complete the trial at the earliest. With the aforesaid observations, the present revisional application being CRR 1749 of 2023 is disposed of. Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court.
