Petitioner seeks anticipatory bail.

Learned Advocate appearing for the petitioners submits that the petitioner was falsely implicated due to village rivalry. He highlights the fact that the complaint was lodged two months after the alleged incident.

Learned Advocate appearing for the State draws the attention of the Court to the statement of the victim recorded under Section 164 of the Code of Criminal Procedure, 1973. In answering to a query of the Court the learned Advocate for the State submits that the victim refused to medical examination. Considering the statement recorded under Section 164 of the Code of Criminal Procedure, 1973 and considering the gravity of the offence we are unable to grant anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail being C.R.M. 4995 of 2021 is rejected.
