By presenting this writ petition, petitioners have prayed for appointment of petitioner no. 2 being son of deceased employee who died-inharness while working in Home Department (Police), Government of West Bengal.

On hearing learned advocates representing the parties, it appears that issue involved in this writ petition relates to appointment of petitioner no. 2 on compassionate ground.

Since father of petitioner no. 2 was State Government employee, writ petition at this stage is not maintainable in terms of Section 15 of the Administrative Tribunal Act, 1985.

Hence, writ petition is dismissed.

However, this order shall not preclude the petitioner to approach before the West Bengal Administrative Tribunal in pursuit of remedy on self-same cause of action.
