1. In this application the petitioner has prayed for a direction upon the Court below for expeditious disposal of the proceeding being G.R. Case No. 7012/2017 presently pending before the learned Judicial Magistrate, 2nd Court at Barrackpore, North 24-Parganas.

Feeling aggrieved and dissatisfied with the delay caused in disposal of the criminal proceeding, learned Counsel appearing on behalf of the petitioner submits that the criminal proceeding was initiated on 10th September, 2017 and after completion of investigation, charge-sheet was submitted on 21st September, 2017. After a delay of several years the charge was ultimately framed on 28th June, 2023. Since then only prosecution witness no. 1 has

been examined in part. Prosecution proposes to examine seven witnesses and as such he sought for appropriate direction upon the Trial Court.

3. Having heard the learned Counsel for the petitioner it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made in the petition the opposite parties will have no cause to prejudice and as such service of copy of the application upon the opposite parties is dispensed with.

4. Having considered the facts and circumstances of the case and that the trial has been stalled for a considerable period of time, I find that the prayer made by the petitioner is justified and is required to be allowed to secure the ends of justice.

5. In view of the above, CRR/2173/2026 is hereby disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the proceeding being G.R. Case No. 7012/2017 and to make his best endeavour to conclude the trial preferably within a period of six months from the next date of hearing.
