Petitioner claims family pension being widow daughter of deceased Group-D employee of a Government aided recognized secondary school. Father of the petitioner was a Group-D staff who was receiving pension and died on 28th November, 1998. After death of father, mother of the petitioner was in receipt of family pension who died on 21st April, 2011. Petitioner claims family pension being widow daughter from the date following the date of death of her mother. In support of claim of the petitioner legal heir certificate dated 19th April, 2024 issued by the competent authority is relied upon which is at page 18 of the writ petition.

Learned advocate representing the petitioner

submits that soon income certificate of the petitioner shall be submitted before the concerned District Inspector of Schools (SE), Howrah being respondent no.3.

State respondents are represented by learned advocate who has submitted that if necessary documents are filed before the respondent no.3 decision to be taken in accordance with law.

Petitioner shall be at liberty to file income certificate at an early date before the respondent no.3. If income certificate along with necessary documents are filed before the respondent no.3 Court expects that said respondent no.3 shall take steps in accordance with law for sanctioning family pension in favour of the petitioner.

The writ petition stands disposed of.
