The petitioner participated in the English B.A Honours Part-III examination and according to her she did not obtain marks as per her expectation.

The petitioner prays for a direction upon the University of Calcutta for re-examination of four answer scripts.

The petitioner has set out the Rules and Regulations pursuant to which re-examination of answer scripts are conducted by the University. It appear therefrom that in the general course in respect of Part-III examination a student shall be allowed to apply for re-examination of not more than two theoretical papers in each semester provided that

he/she has scored qualifying marks i.e. 30% in the remaining papers of that semester.

In accordance with the aforesaid Regulation, the petitioner presently prays for re-examination of papers V and VII of her B.A. Honours Part-III examination. As it appears that the Regulation of the University of Calcutta permits re-examination of two papers in respect of the candidates who have scored more than 30% in the remaining papers and as the petitioner has the qualifying marks accordingly, the instant writ petition is disposed of by directing the University to take steps for re-examining papers V and VII of the petitioner's B.A. Honours English Part-III examination.

The re-examination shall be completed within a period of six weeks from date. The University shall intimate the fate of the re-examination to the petitioner immediately thereafter.

In the event, it eventually appears that the petitioner is entitled to more marks the University shall take necessary steps to issue fresh mark-sheet incorporating the correct marks in favour of the petitioner.

W.P.A. 12077 of 2021 stands disposed of.
