Kausik (Rejected) CRM (NDPS) 1112 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kotwali Police Station Case No. 1402 of 2025 dated 20.12.2025 under Sections 21(c)/29 of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits that the alleged recovery in the present case is 805 Gms. of Heroin and the petitioners being ladies are in custody for more than 6 months.

Learned advocate for the State opposes the prayer for bail and submits that the recovery was from both these petitioners.

Having considered that the rigors of Section 37 of the NDPS Act being attracted, I am not inclined to release the petitioners on bail.

Accordingly, prayer for bail of the petitioners in CRM (NDPS) 1112 of 2026 is dismissed.
