In the matter of : Sumitra Bhattacharya & Anr. ..... petitioners Mr. Asimes Goswami Ms. Paulomi Banerjee ....For the petitioners This is an application for quashing of a charge sheet being no. 249 of 2020, dated August 30, 2020 under Sections 341/323/504/34 of the Indian Penal Code, 1860, pending before the Court of the learned Judicial Magistrate, 5th Court at Serampore, Hooghly.

It has been submitted by Mr. Asimes Goswami, learned advocate for the petitioners, that in the charge-sheet, no case has been made out disclosing ingredients of offences under the above mentioned sections. It has further been submitted that the version of the charge sheet is not corroborated by any medical report.

I am not inclined to interfere with the proceeding at this stage. Petitioners shall be at liberty to agitate the points available to them at the time of framing the charge before the learned Magistrate in the Court below for their discharge. Learned Magistrate in the Court below shall consider all points raised by the petitioners in accordance with law. The revisional application being CRR 1526 of 2021 is disposed of.
