Sabir Ahmed, Mr. Apan Saha, ... for the petitioners Ms. Sukanya Bhattacharya, Mr. Pratick Bose, ... for the State Mr. Mujibar Ali Naskar, ... for the opposite party No. 2 The petitioners in this application are accused of a criminal case which resulted in the filing of a charge sheet being Charge Sheet No. 115 of 2020 under Sections 341/323/325/34 of the Indian Penal Code, 1860.

The petitioners/accused persons, the de-facto complainant/victim and the other victims are all students of an engineering college namely, Netaji Subhas Engineering College, at Garia.

It has been submitted by the learned advocates appearing for the respective parties that the disputes between the accused

persons and the aforesaid victims have been amicably settled, and the said victims, including the de-facto complainant, do not want to proceed with the present criminal case. CRAN 1 of 2021 has been filed by the petitioners/accused persons along with Amrit Kumar Shukla, who is victim/ de-facto complainant for quashing the present criminal case on the ground of compromise.

Similarly, CRAN 2 of 2021 and CRAN 3 of 2021 have been filed by Badal Kumar Singh and Subham Kumar, respectively, who are the remaining victims in this case, for quashing of the case on the same ground.

It is submitted that since all the accused persons are students, the pendency of this criminal case will cause serious prejudice to their future.

Having regard to the fact that the alleged offences involved in this case are compoundable in nature and the victims, including the de-facto complainant, are not willing to proceed with the present criminal case any further, I do not see any justification for the continuation of the present criminal case. In that view of the matter, the proceeding arising out of G.R. Case No. 1157 of 2020 under Sections 341/323/325/34 of the Indian Penal Code, 1860, pending before the Court of the learned Additional Chief Judicial Magistrate, Baruipur, South 24 Parganas, stands quashed.

The revisional application being C.R.R. 1519 of 2021 along with C.R.A.N. 1 of 2021, C.R.A.N 2 of 2021 and, C.R.A.N. 3 of 2021 are, thus, disposed of.

In view of the quashing of the present criminal case, the petitioners are discharged from their respective bail bonds furnished by them before the learned Additional Chief Judicial Magistrate, Baruipur, South 24 Parganas.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with all necessary formalities.
