Heard learned counsels for the parties.

The private respondent agrees to refund the consideration amount paid by the petitioner to him to the tune of Rs.6,10,000/- and seeks to pay the same in installments. The petitioner agrees to return the vehicle upon receipt of the entire amount paid by him. In view of the above, the writ petition is disposed of directing the private respondent to pay the amount of Rs.6,10,000/- to the petitioner in two equal installments of Rs.3,05,000/- each, first installment being payable within 31st August, 2023 and second installment within 30th September, 2023. The petitioner shall return the vehicle to the private respondent within two days of receipt of the entire amount of consideration. With the aforesaid directions, WPA 11540 of 2023 is disposed of.

There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties on usual undertakings. (Suvra Ghosh, J.)
