17.06.2022 sdas rejected C.R.M. (NDPS) 655 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with RPF/PST/HWN's G.D. No. 70 dated 05.02.2020 under Section 42 of the NDPS Act and subsequently renumbered as T.R. 07 of 2020 under Sections 20b)(ii)(C )/29 r/w 35 of NDPS Act.
And In Re : Purnima Devi ..... petitioner Mr. Angshuman Chakraborty ... for the petitioner Learned Counsel appearing for the petitioner prays for bail. She is in custody for two years and four months. Learned Counsel contends that co-accused was granted bail. Learned Counsel for the State opposes the prayer for bail.
We have considered the materials on record. Petitioner and co-accused were arrested at the spot. Collective recovery of narcotics from the petitioner and co-accused is above commercial quantity.
In view of total quantity of narcotic substance i.e. 39.5 kgs. of Ganja recovered from the petitioner and co-accuseds which is above commercial quantity attracts the statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.
The application for bail is, thus, rejected.
Trial court is directed to expedite the trial and conclude the same without granting any unnecessary adjournment to either of the parties.
